On September 5, 2020, Thai government published the Civil Procedure Code Amendment Act (No.32) B.E. 2563 (2020), which will come into effect on November 7, 2020. The Act introduces pre-litigation civil mediation, which means that a party can submit a court-supervised mediation prior filing a law suit. The mediation intends to save time and money for settling disputes.
泰國政府於2020月9月5號公告了佛曆2563年(西元2020年)第32號《泰國民事訴訟法》修正案[1],將於2020月11月7號正式實施。新法案引入訴訟前民事調解程序,當事一方可在起訴前提交調解申請,嘗試以較省時及省錢的方式解決爭議案件。
Under section 23 Ter, a party may express their intention to request a mediator before going to court. If the petition is accepted and both parties mutually consent to the mediation, the court will appoint a mediator based on section 20 bis of the Civil Procedure Code. If the mediation is successful, the court will request both parties to sign a written agreement. The court will verdict the dispute if necessary. After the judgment is made, the decision can only be appealed if there is an allegation of fraud against any party.
第23條之三當事一方可向相關法院提出有意調解的意願。如法院同意且雙方有意調解,法院會依據《泰國民事訴訟法》第20 bis條舉派一位調解員。如調解成功法院會要求雙方簽署協議,有必要時法院也會做出裁定;法院裁定後只有指控對方舞弊的情況下案件才能上訴。
On the other side, if the mediation fails, and the prescribed period lapses during the mediation procedure or within 60 days from the date of submission of the petition, such period will be extended for another 60 days from the end of the mediation.
另一方面,如調解不成功,且規定的期限在調解程序中或從申請調解之日起60天失效,該期限將自調解結束後再延長60天。
