Thai Hotel Association (“THA”) recently approved the Thai Ministry of Interiors’ new regulations which allows smaller accommodation operated prior to 2016 to be regulated as hotels, as the government will be able to receive more income from tax collection. However, the association still opposes the plan to exempt large forms of accommodation from registering under Thai Hotel Act.

On 20 June 2023, the Thai Interior Ministry announced that ministerial regulations which allowed other types of buildings which does not fall into the definition of “hotel” based on the Thai Hotel Act, but had opened before 19 August, 2016, to be able to register for hotel licenses. Under the regulations of the Thai Hotel Act, these buildings are not required to adjust structural components, such as mandatory empty space, the size of corridors and staircases, but these buildings must have strong foundations and fire safely measure in place.

Further requirements include evidence of property tax payments and land and website advertisement to guarantee their operations have been starting since before August 19, 2016.

In the past, smaller operations were struggled to register as hotels due to the structural limitations of existing buildings. With the effect of the new regulations issued by the Thai Ministry of Interiors, making it a fair ground for all. However, there may be potential issues of unfair treatment as these are investing in property adjustments, such as room reduction for additional space in order to fit to prior regulations. The government should consider financial easement, for example, tax reductions or to provide another form of subsidy.

Mr. Udom Srimahachota, who is honorary advisor at Thai Hotels Association, claimed that the plan to exempt properties with no more than 8 rooms serving no more than 30 guests from Hotel Act was unacceptable. With the current law, the exemption has been made for properties of no more than 4 rooms with no more than 20 guests, which may bring up safety risk issues for guests who choose this type of property.
泰國酒店協會名譽顧問 Udom Srimahachota 先生表示,對客房數不超過 8 間、服務人數不超過 30 人的酒店實行《泰國酒店法》豁免的計劃不可接受,因為根據現行法律,豁免已適用於以下酒店:房型不超過4間,入住人數不超過20人,對於選擇此類房型的房客來說可能會帶來安全風險。
